HOV Violators

If an out of stater gets a ticket in Virginia that has "points", does he get assessed the points in New Jersey or whatever, or does that person just pay the fine to VA?

I lived in both VA and NY for a while, I received tickets in both states on both licenses, they did not carry over from one state to the other, and they both worked a point system. Now, where the $ was concerned, the state you are fined in is the state that gets the $, from what I have seen.

Just remember that Law Enforcement officials (LEO) are exempt from HOV laws. Why is it that no one begrudges them from using these lanes, just the Hybrid people? I say the law should be applied evenly, why do LEO's get special rites? They are going to/from work like everyone else.

Please note, Virginia code states “Law-enforcement vehicles”, not “Law-enforcement officers”. The question becomes what constitutes a law enforcement “vehicle”. It appears that the state police have made their interpretation of the law to include anyone in a law enforcement capacity, if they have a uniform or a blue light to make it so. While it may not be an accurate interpretation, not much you can do about it. Just the good ole boy system.

§ 33.1-46.2. (For expiration date /- See Editor's note) Designation of high-occupancy vehicle lanes; use of such lanes; penalties.
A. In order to facilitate the rapid and orderly movement of traffic to and from urban areas during peak traffic periods, the Commonwealth Transportation Board may designate one or more lanes of any highway in the interstate, primary, or secondary highway systems as high-occupancy vehicle lanes, hereinafter referred to in this section as HOV lanes. (etc).
1. Emergency vehicles such as fire-fighting vehicles, ambulances, and rescue squad vehicles,
2. Law-enforcement vehicles,
3. Motorcycles,
4. a. Transit and commuter buses designed to transport 16 or more passengers, including the driver,
b. Commuter buses and motor coaches operating under irregular route passenger certificates issued under § 46.2-2010 and any vehicle operating under a certificate of Public Convenience and Necessity or as a common carrier of passengers under § 46.2-2075 or § 46.2-2080,
5. Vehicles of public utility companies operating in response to an emergency call,
6. Until July 1, 2007, vehicles bearing clean special fuel vehicle license plates issued pursuant to § 46.2-749.3, or
7. Taxicabs having two or more occupants, including the driver
