As many of you know, Loudoun Co. is suing the state of VA over the new regional taxes. What about the possibility of say, Prince Wm County suing the state of Va over HOT lanes? Has anyone asked Corey Stewart or any of the other supervisors about this?

We would have to be able to prove damages as defined under the law. Even the most liberal legal interpretation would have a hard time proving a toll as damages. And the propiganda form Flour and VDOT has already built a strong case that HOT lanes increase and improve commuting options. While it is all self-serving, white-wash, it is published and has established a POV precident.

I think there would be a stronger case proving improper contracting procedures, such as improper sole-source contract award, inadequate public notification, disclosure, and review prior to the contract award, and failure to follow proper environmental analysis (including ecological, economical, and user impact studies) procedure prior to contract award.

Thanks for your input. I guess one thing that really riled me yesterday was when I was looking at the website by the VA Department of Rail and Public Transportation

and they were talking about the Freedom of Information act. Basically what they say is that we cannot gain access to anything related to the contract negotiations until the contract is signed. What a crock.

New bill proposed by Kay Bailey Hutcheson to ban tolling of existing interstates.
